Hangarfolio Terms of Use (End User License Agreement)

1. Acknowledgement

These terms are an agreement between you and Mountain Buffalo Limited (“Mountain Buffalo”, “we”, “us”), not Apple. Mountain Buffalo, not Apple, is solely responsible for Hangarfolio and its content. By downloading or using Hangarfolio, you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use Hangarfolio.

2. License

We grant you a non-transferable, non-exclusive license to use Hangarfolio on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy (except as those rules allow), modify, reverse-engineer, rent, lend, sell, redistribute or sublicense Hangarfolio, or try to derive its source code, except where the law allows it despite this restriction.

3. What Hangarfolio is and is not

Hangarfolio helps aircraft owners keep track of maintenance, flights, squawks, schedules and costs. It is a convenience, not a substitute for your aircraft’s official records or for your own judgment.

  • You remain responsible for airworthiness. Under the aviation regulations that apply to you, the pilot in command and the owner or operator are responsible for the aircraft’s airworthiness and for maintaining it and its records. Hangarfolio’s status, due dates and reminders depend on what you enter and may be wrong, late or missing. Always check the aircraft’s logbooks and records, and the applicable regulations, airworthiness directives and manufacturer instructions.
  • Records in Hangarfolio aren’t your official logbooks. Maintenance entries and returns to service still need to be made in the aircraft’s records by the appropriate person, as the regulations that apply to you require. Hangarfolio isn’t a recordkeeping system approved or accepted by any aviation authority, and you’re responsible for keeping any record the regulations require, including signed entries such as VOR checks.
  • Reminders and notifications are a courtesy. They can fail to arrive, for example if notifications are off, your device is offline, or a service is down.
  • The ledger is a record-keeping tool. Hangarfolio doesn’t move money, hold funds or collect payments between owners. Balances are calculated from what owners enter. Settling up, and any disagreement between co-owners, is between the co-owners.
  • Hangarfolio doesn’t provide legal, tax, financial or aviation advice.

4. Accounts

You don’t need an account to track an aircraft only you use. To share an aircraft or join one, you need a Hangarfolio account. Give accurate information, keep your sign-in secure, and tell us about unauthorized use. You’re responsible for activity under your account. You can delete your account in the app at any time. The Privacy Policy explains what happens to your data.

5. Shared aircraft and your content

  • Your content is everything you enter or upload, such as aircraft details, entries, photos and receipts. It remains yours. You give Mountain Buffalo a limited license to store, copy and display it, only to operate Hangarfolio for you and the co-owners you share with.
  • Co-owners are equal. Everyone on a shared aircraft can see and change its information, invite or remove others, and see each owner’s flights, bookings and costs. Only invite people you trust with that access.
  • When you leave or are removed from a shared aircraft, or delete your account, entries you made on it stay with the aircraft for the remaining owners, without your name after account deletion.
  • You’re responsible for having the right to share what you upload, and for the accuracy of what you enter.

6. Acceptable use

Don’t use Hangarfolio to break the law, infringe others’ rights, harass anyone, upload malicious code, overload or probe our systems, access accounts or aircraft you haven’t been invited to, or resell the service.

7. Subscriptions and purchases

  • Sharing an aircraft with co-owners needs a Hangarfolio subscription. Joining someone else’s shared aircraft is free.
  • Plans cover one, two or five aircraft, as described at purchase. Prices are shown in the app before you buy.
  • Subscriptions are sold by Apple. They renew automatically unless cancelled at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours before the end of the period. You manage or cancel your subscription in your Apple Account settings. Refunds are handled by Apple under its policies; Mountain Buffalo can’t issue refunds directly.
  • Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends.
  • If a subscription ends, nothing is deleted. The aircraft stops being shared until an owner subscribes again.

8. Maintenance and support

Mountain Buffalo, not Apple, is solely responsible for maintenance and support of Hangarfolio. Apple has no obligation to provide any maintenance or support. Contact support@mountainbuffalo.com.

9. Warranty disclaimer

Hangarfolio is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the extent the law allows. We don’t warrant that Hangarfolio will be uninterrupted, error-free, or that data will never be lost. If Hangarfolio fails to conform to any warranty that the law requires, you may notify Apple, and Apple will refund the purchase price for Hangarfolio, if any. To the maximum extent the law allows, Apple has no other warranty obligation with respect to Hangarfolio. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Mountain Buffalo’s responsibility, to the extent they aren’t disclaimed.

10. Limitation of liability

To the fullest extent the law allows, Mountain Buffalo won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. This includes damages arising from reliance on Hangarfolio’s maintenance status, due dates, reminders or records, or from the operation of any aircraft. Our total liability for any claim relating to Hangarfolio is limited to the greater of the amount you paid for Hangarfolio in the 12 months before the claim, or US$50. Some jurisdictions don’t allow these limits, so they may not apply to you.

11. Product claims

Mountain Buffalo, not Apple, is responsible for addressing any claims by you or a third party relating to Hangarfolio or your use of it. That includes product liability claims, claims that Hangarfolio fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.

12. Intellectual property

Hangarfolio, its design and its content (excluding your content) belong to Mountain Buffalo and its licensors. If a third party claims that Hangarfolio or your use of it infringes their intellectual property rights, Mountain Buffalo, not Apple, is solely responsible for investigating, defending, settling and discharging the claim.

You represent that you aren’t located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you aren’t on any U.S. Government list of prohibited or restricted parties.

14. Eligibility

You must be at least 18 years old, or the age of majority where you live, to use Hangarfolio.

15. Third-party terms

You must comply with applicable third-party terms when using Hangarfolio, such as your wireless carrier’s terms. Apple’s services, including iCloud and the App Store, are subject to Apple’s terms.

16. Termination

You can stop using Hangarfolio and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to by law. Where we can, we’ll give notice and a chance to export or move your data. If we stop offering Hangarfolio’s online service, we’ll give reasonable notice. Aircraft only you use stay on your devices and in your iCloud.

17. Changes to these terms

We may update these terms. We’ll post changes on this page and update the effective date. If a change is significant, we’ll tell you in the app before it takes effect. Continuing to use Hangarfolio after that means you accept the updated terms.

18. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise.

19. Third-party beneficiary

You and Mountain Buffalo acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary.
